Terms and Conditions

It is each individual traveler's responsibility to read and understand the terms and conditions of Sunshine Wine Concepts, LLC prior to submitting a tour reservation.

PARTIES: Sunshine Wine Concepts, LLC, provides wine and culinary tours to both U.S. and international destinations. These Terms and Conditions apply to each Tour program provided by Sunshine Wine Concepts, LLC. In these Terms and Conditions, the undersigned is hereinafter referred to as "Guest" and Sunshine Wine Concepts, LLC is hereinafter referred to as “the Company.”

RESERVATIONS are accepted by the Company upon receipt of a non-refundable deposit of US$500 per Guest per Tour, payable to Sunshine Wine Concepts LLC and mailed to 1605 Renaissance Commons Blvd. #438, Boynton Beach, FL 33426.. The remaining balance of the Tour is due no later than 60 days prior to the Tour departure date, and invoices for final payment of Tour will be emailed to each Guest prior to the Tour final payment due date. Reservations made within 60 days of Tour departure date must be accompanied by full payment. If the Company does not receive final payment of Tour from Guest by 60 days prior to Tour departure date, the Company reserves the right to cancel Guest's reservation at which time Guest forfeits the non-refundable deposit. International tours, private tours and custom designed tours require a non-refundable deposit of $1000 per person, and final tour payment for international tours, private tours and custom designed tours is due no later than 90 days prior to the tour departure date.

CLIENT CANCELLATION & REFUND POLICY: If Guest chooses to cancel his or her reservation, the Company must receive written notice of said cancellation in writing via certified mail, or e-mail to mark@spivakonwine.com (with confirmation of receipt from the Company), and Guest shall be subject to the following cancellation fee schedule: If the Company receives written notice 61 or more days prior to the Tour start date, the Company shall with-hold the non-refundable deposit. If the Company receives written notice 31-60 days prior to the Tour start date, the Company shall with-hold the non-refundable deposit and Guest shall incur a cancellation fee equal to 50% of the remaining balance due for the Tour. If the Company receives written notice 30 days or less prior to the Tour start date, the Company shall with-hold the non-refundable deposit and Guest shall incur a cancellation fee equal to 100% of the remaining balance due for the Tour. If the Company receives no written cancellation from Guest and Guest does not show-up for the Tour per Guest reservation, Guest shall incur a cancellation/no-show fee equal to 100% of the Tour price. Cancellation date is the date such notice is received in writing by and acknowledged as received by the Company. Cancellation fees for international tours, private tours and custom designed tours are as follows: If the Company receives written notice 91 or more days prior to the Tour start date, the Company shall with-hold the non-refundable deposit and Guest shall incur a cancellation fee equal to 25% of the remaining balance due for the Tour. If the Company receives written notice 61-90 days prior to the Tour start date, the Company shall with-hold the non-refundable deposit and Guest shall incur a cancellation fee equal to 50% of the remaining balance due for the Tour. If the Company receives written notice 60 days or less prior to the Tour start date, the Company shall with-hold the non-refundable deposit and Guest shall incur a cancellation fee equal to 100% of the remaining balance due for the Tour.

CANCELLATION OR SUBSTITUTION: The Company may cancel any Tour at any time before departure for any reason, including without limitation, if the Company deems the number of Guests signed up for a given Tour to be insufficient to operate such Tour. The Company may in its' sole discretion substitute a Service or Good of similar quality for any Service or Good stated in a Tour itinerary. The Company shall attempt to notify Guest of the cancellation of a Tour for which Guest has paid a deposit or Tour Fee as soon as possible after Sunshine Wine Concepts’ final decision to cancel such Tour. If a Tour is cancelled, the Company’s liability is limited to a full refund of affected Guest's Tour deposits and Tour Fees, and the Company will not be liable for any other costs, damages, or refunds of any kind for any loss, delay, inconvenience, disappointment, or expense whatsoever in such circumstances. The Company is not responsible for any loss incurred on account of non-refundable or non-transferable air tickets. If for reasons beyond the Company’s control, a Tour in progress must be interrupted or cancelled, the Company will in good faith refund a portion of the Tour Fees depending on the Company's actual costs incurred compared to the Tour as originally contemplated.

INCLUDED: in the price of the Tour are the following: A Tour leader who also serves as Guests' liaison during the Tour; hotel accommodations as designated by the Company during the Tour; entry fees to each event detailed in the finalized tour itinerary; fees for interactive excursions during the Tour as detailed in the finalized itinerary, such as, cooking classes, wine tasting workshops, some beverages during meals provided on the Tour as detailed in the finalized tour itinerary, hotel taxes, breakfast as detailed in the finalized tour itinerary, gratuities to service personnel at restaurants designated in the finalized itinerary and at the hotel, meals as specified in the finalized itinerary, private ground transportation during the tour from Tour start date pick-up and Tour conclusion drop-off.

NOT INCLUDED: in the cost of the Tour are the following: Roundtrip airfare to and from the start of the Tour, telephone calls, personal items, laundry, individual purchases, pre-dinner alcoholic beverages except as specified in the finalized itinerary, wines beyond provisions of the tour, extra meals or snacks, room service, cocktails, or personally ordered wines, even if consumed in place of provisions provided during the Tour, and any other costs not specified in the finalized Tour itinerary or elsewhere in writing. Guest is responsible for all of the above and the cost of any changes he or she makes outside the Tour and Tour provisions. Guest is responsible for transportation costs to and from the Tour hotel in the event that Guest is unable to participate in the group pick-up on tour start day and/or group drop-off on tour conclusion day.

PRICES: The Company only guarantees a Tour price as indicated on our website upon the Company's receipt of Guest's deposit. Otherwise, prices are subject to change without notice. Once the Company receives Guest's deposit, Guest's Tour price is guaranteed and the Tour price will not increase.

ACCOMMODATIONS: Guest accommodations during a Tour are double or twin occupancy (single supplement is allowed upon request for an additional fee), and will include private, fully equipped bathrooms. Hotels are selected for their charm, comfort and luxury. Hotel rooms are well appointed, individual, private rooms with large comfortable queen or king size beds and fully equipped, private bathrooms that the Company has determined to meet its strict criteria.

RESPONSIBILITY: The Company expressly limits its performance to the delivery of a Tour with accompanying food, lodging and ground transportation from site to site, as specified in the itinerary. The Company and its agents will not be responsible for any direct or indirect consequential damages or injury that may result from a Tour. The Guest is completely responsible for all actions, and agrees to hold harmless the Company and its' agents for any accident, damages or injury. The Company and its agents are not responsible for Acts of God or acts of war/terrorism, and Guest agrees to hold the Company and its' agents harmless for any incident or injury resulting from the same. Only the Company may finalize an order or Tour booking and make it a binding contract to provide the services of the Company to Guest. Responsibilities of Guest include, but are not limited to the adherence of all local laws, assessing abilities, respecting other Guests' privacy, and following the suggestions and advice of the Company’s agent during a Tour. The Company reserves the right to decline, accept, or retain at any time, any Guest, as a participant of a Tour, if the Company deems that Guest behavior is disruptive to the group or Tour, is inappropriate and offensive to the Group or interferes with the delivery of services of the Tour. The Company reserves the right to remove any Guest from a Tour should the Company determine that the Guest cannot meet the physical requirements of the Tour, as stated in the Tour itinerary, or is disruptive to the Tour time schedule, or is adversely affecting the overall group dynamics. In the event that a Guest is removed from a Tour, the Company will not refund any monies to the Guest. Transportation costs to return home, airline penalties, and any other expenses will be the responsibility of the Guest. In the event that a Guest voluntarily chooses to leave a Tour, the Company will require a written, signed statement of the Guest's intent to depart from the Tour. In the event that a Guest voluntarily departs from a Tour, the Company will not refund any monies to the Guest. Transportation costs to return home, airline penalties, and any other expenses will be the responsibility of the Guest. During a Tour, Guest participates in as many or as few activities of interest to him or her. No refunds for unused services, activities, excursions, workshops or portions of a Tour for any reason will be made to Guest.

INSURANCE: Trip cancellation/interruption insurance is recommended, but not required to participate in a Tour. Trip cancellation/interruption insurance will protect Guest should he or she need to cancel for certain necessary reasons such as illness, unemployment, death, and provides Guest refunds for air and Tour in full. Additional insurance for baggage, health/accident is also strongly recommended and available through most major travel insurance providers.
